1. Acceptance of Terms
By accessing or using the ALMS NZ platform, you agree to be bound by these Terms of Use. If you do not agree, you must not use the platform. These terms apply to all users including teachers, students, school administrators and visitors.
2. Eligibility
ALMS NZ is available exclusively to:
- New Zealand secondary schools registered on the platform.
- Teachers and staff employed by a registered school.
- Students enrolled at a registered school and added to a class by their teacher.
Use by individuals outside these categories is not permitted without prior written approval from ALMS NZ.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately if you suspect unauthorised access to your account.
Accounts are personal and must not be shared with others.
You must provide accurate information when registering and using the platform, and keep it up to date. Providing false information, including misrepresenting your school affiliation, may result in immediate termination of access.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable law.
- Upload or share content that is offensive, defamatory, discriminatory or harmful.
- Attempt to gain unauthorised access to any part of the platform or another user's data.
- Interfere with the operation of the platform or its infrastructure.
- Use automated tools to scrape, crawl or extract data from the platform.
- Impersonate another person or misrepresent your affiliation with any school.
- Collect or harvest personally identifiable information from other users.
5. Content Ownership
Teachers retain ownership of lesson content, assessments and resources they create on the platform. By uploading content you grant ALMS NZ a limited licence to store and display that content for the purpose of operating the platform.
Student work and submissions remain the intellectual property of the student. Teachers may access student submissions for assessment and feedback purposes only.
All platform software, interfaces, design and underlying systems are owned by or licensed to ALMS NZ and are protected by copyright and applicable intellectual property laws. You may not reproduce, distribute, modify or create derivative works of any platform content without prior written consent.
6. Teacher and Staff Responsibilities
Teachers and educational staff are responsible for ensuring they have proper authorisation from their school to access and manage student data. All use of student information must be in accordance with the school's own policies and applicable New Zealand law, including the Privacy Act 2020.
Teachers must ensure that any assessment data and student information is used solely for legitimate educational purposes.
7. Platform Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. The platform may be unavailable during scheduled maintenance or due to circumstances outside our control. We will endeavour to provide advance notice of planned downtime.
The platform is provided on an "as is" basis. We do not warrant uninterrupted or error-free operation, compatibility with all devices or browsers, or the accuracy of all assessment data.
8. Limitation of Liability
To the extent permitted by New Zealand law, ALMS NZ is not liable for any indirect, incidental or consequential loss arising from your use of the platform, including:
- Loss of data or assessment information.
- Interruption of teaching or learning activities.
- Technical failures or system downtime.
- Third-party actions or content.
9. Third-Party Services
ALMS NZ integrates with third-party services to operate the platform. These providers are bound by appropriate data processing agreements. Your use of those services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
10. Termination
We reserve the right to suspend or terminate access to the platform for any user or school that breaches these terms, without notice where necessary to protect the platform or other users.
11. Changes to These Terms
We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. Significant changes will be notified to school administrators.
12. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.
13. Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
